Formative – also known as Formative, GoFormative and Smartest Edu, Inc. (“Formative”, “we”, “us” or “us”) – is committed to protecting your privacy. We understand how important privacy is to you and are committed to creating a safe environment for learners of all ages. This Privacy Policy applies to formative.com, our application programming interface (“API”) and online services (collectively, our “Properties”), all owned and operated by Formative. This Privacy Policy describes how Formative collects and uses the information you provide on our properties, the choices available to you regarding our use of your personal information, and how you can access and update that information. We strive to comply with U.S. federal, federal, and international regulations. This includes (but is not limited to) FERPA, COPPA, GDPR and California AB 1584. The privacy of young children is particularly important to Formative. For this reason, we have developed certain features to protect the personal information of all students who create accounts on our website (“Student Users”). Formative also obtains parental consent for all “student users”. If you are a parent or guardian (“Parent”) and you discover that your child has a registered account with our Properties without your consent, please notify Formative privacy@formative.com and ask us to delete that child`s personal information from our systems. Alternatively, if you are a parent, you can give your consent to your child`s registration via email. Parents may revoke a child`s permission to use the Properties by sending an email to privacy@formative.com to delete the account. Hello, hello! To permanently delete your account or make other changes, envoyez-support@formative.com an email. Parents can edit or delete student user accounts. If you encounter any difficulties in this process, please contact us as described below. If you have any questions or comments regarding this Privacy Policy, your personal information, our disclosure practices to third parties, or your consent choices, please contact Formative by email at privacy@formative.com or by mail at: Formative, 1158 26th Street, #161, Santa Monica, CA 90403. A child can be registered through his school for the use of the property; either by integration with the characteristics supported by the child`s school; or teachers, guardians and other similar adults who support the educational process (“teachers”) and have taken steps to obtain parental consent. Parents have the option to delete their student user`s account at any time by contacting privacy@formative.com. An essential part of our service is sharing data with school administrators and other authorized stakeholders. For this reason, school organizations often need to go back over previously collected data and determine whether the user is still active or not. For these purposes, we will retain your information for as long as your account is active, as authorized by your school organization, or as reasonably useful for possible use by your school organization.

You or an authorized representative of the school (if you are authorized or using it for personal reasons) may request deletion of your account and information by sending an email to privacy@formative.com. If the account is no longer active and the school organization has not requested the data within 10 years, we will delete your data. In some specific requirements, we may be able to create and manage isolated servers outside the United States based on specific international partnerships. Please contact us at privacy@formative.com regarding this requirement. If you are under the age of 18 or parent of a user under the age of 18 and a California resident, you may request removal of any content or information you have posted on our Properties. If you would like to request deletion of your or your child`s content or information, please email us at privacy@formative.com for assistance, or you can delete certain information directly (or delete your account or your child`s account). Please note that deletion of your content or information does not guarantee complete or complete deletion, as there may be any form of anonymized or recoverable elements of your content or information on our servers. In addition, we will not delete any content or information that we may be required to retain under applicable federal and state laws. You can change or delete personal data in our records. Like most websites, whether you are a registered member or not, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your computer.

Cookies store information about your activities on a website and allow us to provide you with a more personalized learning experience. Formative may use both session cookies and persistent cookies. A session cookie disappears automatically when you close your browser. A persistent cookie remains after you close your browser and can be used by your browser on subsequent visits to the website. However, you can delete a persistent cookie at any time. Please consult your web browser`s “Help” file to learn how to correctly change your cookie settings. However, without cookies, you will not have access to certain services and features of the website. When a student user attempts to register with our property, Formative requests an authorization code, which must be created and provided by their teacher. Teachers cannot share these codes with children or create accounts for children unless they are authorized to consent to the sharing of that student`s personal information (name, email, replies, etc.). Again, we will never sell student data. It is up to teachers and students to determine if and how this information is shared.

Formative may disclose information that we believe in good faith appropriate or necessary to provide safeguards against liability; to protect trainers from fraudulent, abusive or illegal use; to investigate and defend against claims or allegations made by third parties; support to state law enforcement authorities; to protect the safety or integrity of our property; or to protect the rights, property, or personal safety of Formative, our users, or others. We may collect information about your location (e.g., your city or school) to provide you with educational experiences tailored to your region, but we do not collect the exact geolocation of you or your device. You may be able to change the settings on your computer or mobile device to prevent it from providing us with location information. Our commitment to the security of personal data extends to all levels of our organization and is demonstrated by relevant policies and the provision of appropriate resources to establish and develop effective privacy and information security controls. Formative will not share personal information with other third-party organizations for marketing or promotional purposes without your consent or as part of a specific program or feature you may sign up for. You may give us permission to share your personal information with authorized partners, non-profit organizations, and other companies not affiliated with Formative. In these cases, we will only provide these third parties with the information that you have authorized or requested to be shared with these third parties. In certain situations, we may receive information, including personal information, from third parties or sources other than our property. For example, if you apply for a job at Formative through an online recruitment site, we will receive the information you provide in your application for this purpose.

If we combine or link information from other sources with personal information we collect through our properties, we treat the combined information as personal information in accordance with this Privacy Policy. As a parent, you can share information about your child as you see fit.
